Terms of Service
These EOS Red Rebirth Terms of Service ("Terms of Service") aim to define the rights, obligations, and necessary matters between Blomics Corp. ("Company") and the user regarding the use of the 'EOS Red Rebirth' game and related services, websites, game-related communities, or gaming social network service platforms (collectively, the "Service") provided by the Company through devices such as PCs.
This Service is available only to users who are 18 years of age or older (however, if the minimum age to use this Service under the applicable laws of the user's country of residence is 18 or older, it means that the user is above that minimum age; the same applies hereinafter). By agreeing to these Terms of Service, the user warrants that they are 18 years of age or older and (if the user is of the minimum age but considered a minor under the applicable
laws) has obtained the consent of a parent or legal guardian.
The Company may establish separate terms of use and policies for paid services and other services ("Paid Service Terms, etc."), and in the event of a conflict with these Terms, the "Paid Service Terms, etc." shall prevail. In addition, to protect the rights and interests of users and maintain order in the game world, the Company may establish specific matters delegated by the Terms as the Game Service Operation Policy ("Operation Policy").
1. Parties
1.1. These Terms constitute a legally binding agreement regarding the Service between the user (or "you") and Blomics Corp. The user must truthfully provide all information requested by the Company to use the Service. If the user provides false information, steals another person's identity, uses a third party's credit card or bank account without authorization, engages in illegal acts such as hacking or abusing illegal programs, or applies for use with the intent to commit illegal acts prohibited by relevant laws, the user cannot claim rights under these Terms, and the Company may cancel or terminate the contract without refund. Furthermore, the Company may refuse service and terminate the contract if parental consent cannot be verified for minors, if the user has been restricted from use within the last 30 days, or if the user is accessing the Service from a country where the Company has not yet decided to provide services.
1.2. Only individuals (not corporations) may create accounts. By using the Company's services or submitting content, the user represents and warrants that they have the legal capacity to agree to these Terms of Service in their jurisdiction of residence.
2. Service Use and Access
2.1. Limited License: On the condition that the user agrees to and fully complies with these Terms of Service, the Company grants the user a non-exclusive, non-transferable, non-sublicensable, revocable limited license to use the Company's services for personal, non-commercial purposes.
2.2. Revocation of License and Service Changes: The Company reserves the right to revoke the limited license granted to the user at its reasonable discretion. The Company may also limit or terminate access, maintain or delete accounts and associated virtual goods/items without liability to the extent permitted by law. The Company reserves the right to modify the service for technical, experiential, legal, or business reasons, including resetting seasons, rankings, or reward systems.
2.3. System Failures: Services may be unavailable due to scheduled or unscheduled technical maintenance. The Company is not liable for any loss of data, transactions, or other losses resulting from such failures, to the extent permitted by law.
2.4. Game Rules: Specific game rules and instructions form part of these Terms, and users must comply with them for each service they choose to use.
2.5. Third-Party Fees: Internet connection fees and banking/credit card fees associated with transactions are the user's responsibility.
2.6. Equipment/Internet: Users must secure and maintain the necessary devices, OS, and network environments at their own expense.
2.7. Consenting to these Terms during registration constitutes a representation that the user is an adult (18+) or has explicit consent from a legal guardian if they are a minor.
2.8. Test Purpose Services: The Company may conduct test services. Data may be modified or deleted without obligation to restore it, and accumulated assets may be reset after the test ends.
3. Account
3.1. Guest Account: If a user uses the Service without creating an account, a "Guest Account" is assigned. Deleting browser caches, cookies, or changing devices may result in the loss of use information and purchased goods. The Company is not responsible for such losses.
3.2. SNS Account: Users may link third-party social networks (e.g., Google, Apple). The Company may collect profile information according to the third party's policies.
3.3. Account Responsibility: Users are solely responsible for maintaining the confidentiality of their login information and for all activities under their account. Selling, transferring, or renting the account is prohibited.
3.4. Inactive Accounts: The Company reserves the right to terminate accounts with no access record for over 1 year without prior notice. Associated virtual items will be deleted without refund.
3.5 - 3.9. Account Termination and Management:
Users may terminate their accounts. Data and items will be lost. Users must manage their passwords and immediately notify the Company of unauthorized use. Notifications to users may be sent via email or posted on the game site.
4. In-Game Currency and Items
4.1. The Service may include in-game currency ("Virtual Goods") and items/services ("Virtual Items"). They must be purchased through authorized channels.
4.2 - 4.5. Virtual Goods and Items represent a limited, revocable license and have no real-world monetary value. They cannot be exchanged for cash or refunded unless expressly permitted by law. External transfer, sale, or exchange is strictly prohibited.
5. User Obligations and Content
5.1. Users must comply with the applicable laws of the region from which they access the Service.
5.2 - 5.8. Users are solely responsible for the content they upload or transmit. The Company is granted a broad license to use, modify, and distribute user content. Users agree not to post illegal, harmful, defamatory, or infringing content. Prohibited behaviors include fraud, hacking, data scraping, selling accounts, cheating (bots, macros), and exploiting bugs. The Company may remove violating content at its discretion.
6. Use of Service
6.1 - 6.4. Services may involve competing with other users, who may be matched randomly or based on criteria. Display names and scores may be visible. Linking third-party platforms to community services means sharing information publicly. The Company is not obligated to monitor community interactions and is not liable for resulting damages.
7. Service Suspension and Termination
7.1 - 7.2. The Company may suspend services for maintenance, security, legal, or business reasons (e.g., merger, business closure), providing prior notice when possible. Compensation for outages is provided per the specified guidelines for paid services, but free services are not eligible for compensation.
7.3 - 7.7. Severe or repeated violations of the Terms (especially sections 5.4 and 5.5) may result in immediate account termination. The Company may investigate usage records to confirm violations. Users may appeal restrictions within 15 days of notice. Fraudulent participation in events or payment chargeback abuse will result in asset recovery and account restrictions.
8. Disclaimer and Limitation of Liability
8.1 - 8.18. The Service is provided "as is." The Company disclaims implied warranties and is not liable for
damages arising from service use, user disputes, force majeure events, telecom disruptions, user negligence, or lack of desired results. Maximum liability is limited to the amount paid by the user within 100 days prior to the claim.
9. Intellectual Property
9.1 - 9.7. All copyrights, trademarks, and intellectual property rights related to the Service belong to the
Company. Submitting content grants the Company a worldwide, royalty-free license to use it. A process is provided for reporting intellectual property infringements.
